These Terms of Service (“Terms”) govern your access to and use of the Buzlin website, mobile applications, and related services (collectively, the “Platform”), operated by Buzlin Holdings Inc. (“Buzlin,” “we,” “us,” or “our”). By creating an account, placing an order, applying to sell on Buzlin, or applying to deliver for Buzlin, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who Can Use Buzlin

You must be at least 18 years old and able to form a legally binding contract to create an account, place an order, sell on Buzlin, or deliver for Buzlin. By using the Platform, you represent that you meet these requirements and that all information you provide is accurate and current.

2. The Buzlin Platform

Buzlin operates a multi-vendor marketplace that connects three kinds of users:

Customers, who browse and order from independent sellers and services listed on the Platform;
Sellers, independent businesses and individuals who list and sell their own products or services through the Platform; and
Couriers, independent individuals who accept and complete deliveries through the Platform.

Buzlin is a technology platform. We do not manufacture, own, or take title to the products sold by sellers, and we do not employ couriers as staff. Sellers are solely responsible for the products and services they list, including their description, quality, pricing, legality, and fulfillment. Couriers are solely responsible for completing deliveries safely and lawfully.

3. Accounts

You need an account to place an order, sell, or deliver on Buzlin — the Platform does not support guest checkout. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.

You may request deletion of your account at any time. See our Privacy Policy for how we handle your data when you do.

4. Ordering, Pricing & Payment

Prices, availability, and delivery times are set by individual sellers and may vary by region and currency. Buzlin currently supports [USD, CAD, KES, TZS] and displays prices in the currency you select in your account preferences; exchange rates shown are for reference and may not reflect real-time market rates.

Accepted payment methods depend on your region and may include cash on delivery, your Buzlin wallet, and card or digital payment through our payment partners (which may include Stripe, PayPal, Flutterwave, or other processors). When you pay by card, your card details are entered and processed directly by our payment partner — Buzlin does not receive or store your full card number.

By placing an order, you authorize us (or our payment partner) to charge your selected payment method for the order total, including any applicable delivery fees, service fees, and taxes.

5. Cancellations & Refunds

You may cancel an order for a full refund only while it is still awaiting seller acceptance. Once a seller has accepted your order, it can no longer be self-cancelled through the app; contact support if you need help.

If you cancel an eligible order, your payment is refunded automatically — to your original payment method if you paid by card or digital payment, or to your Buzlin wallet if you paid by cash or wallet. After delivery, you may request a refund by describing the issue and, where applicable, providing photos; approved post-delivery refunds are credited to your Buzlin wallet rather than reversed to your original payment method.

Sellers and couriers are paid out according to the payout method they select when applying (direct bank transfer or PayPal), based on the deliveries and orders they complete.

6. Delivery & Order Tracking

Where a delivery is involved, you can view your order’s status (such as accepted, preparing, on the way, or delivered) from your account. Delivery times shown are estimates, not guarantees, and can be affected by factors outside our or the seller’s or courier’s control.

7. Becoming a Seller

To sell on Buzlin, you apply through the Become a Seller flow, providing business or personal information, identification documents, and — for business accounts — registration and tax documentation, all of which we review before approval. Sellers are responsible for the accuracy of their listings, for holding any licenses or permits their products or services require, for complying with applicable consumer protection, food safety, and tax laws, and for fulfilling orders they accept.

8. Becoming a Courier

To deliver on Buzlin, you apply through the Become a Courier flow, providing vehicle information, identification, and — for motorized vehicles — a valid driver’s license and proof of insurance, and you consent to a background check as part of your application.

Courier applications collect background-check consent, but no third-party background-check provider is currently integrated — no check is actually performed yet. Do not publish or market language implying couriers are vetted until this is either true or the language is adjusted.

Couriers using the Platform do so as independent contractors, not as employees, agents, or partners of Buzlin. You are responsible for your own vehicle, insurance, taxes, and compliance with local transportation and licensing laws.

Independent-contractor classification carries real regulatory weight and varies by jurisdiction (e.g. Ontario’s Digital Platform Workers’ Rights Act, California’s Prop 22) — confirm this framing with counsel for every jurisdiction you operate couriers in before publishing.

9. Reviews & Ratings

After a delivered order, customers may rate and review the seller and the courier. Reviews must reflect a genuine experience with that order — you may not post reviews you were paid or incentivized to write, and you may not review your own business or a competitor’s in bad faith. We may remove reviews that violate this section or applicable law.

10. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose or in violation of any applicable law;
List, order, or deliver goods that are illegal, counterfeit, stolen, or that infringe another party’s intellectual property;
Provide false information during registration, application, or ordering, including impersonating another person or business;
Interfere with or disrupt the Platform’s operation, or attempt to access accounts, systems, or data you’re not authorized to access;
Harass, threaten, or discriminate against another user, including on the basis of a protected characteristic under applicable law; or
Circumvent the Platform to transact directly with another user in order to avoid fees, once introduced through Buzlin.

11. Intellectual Property

The Buzlin name, logo, and Platform (excluding seller-supplied content) are owned by Buzlin Holdings Inc. and protected by intellectual property law. You may not copy, modify, or create derivative works of the Platform without our written permission. Sellers retain ownership of their own content (listings, photos, descriptions) but grant Buzlin a license to display it on the Platform.

12. Third-Party Services

The Platform integrates third-party services for payments, mapping, messaging, and notifications. Your use of those services may be subject to their own terms and privacy policies, in addition to ours.

13. Disclaimers

The Platform is provided “as is” and “as available.” Buzlin is a marketplace facilitator — we do not guarantee the quality, safety, legality, or timeliness of any product, service, or delivery provided by a seller or courier, and we are not a party to the transaction between a customer and a seller. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Buzlin will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform.

A liability cap (e.g. the greater of the fees you paid us in the preceding 12 months, or a fixed amount) is standard here — the exact figure and structure needs a legal and business decision.

Nothing in these Terms limits liability that cannot be limited under applicable law, including for gross negligence, fraud, or death or personal injury caused by our negligence.

15. Indemnification

You agree to indemnify and hold Buzlin harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or content or products you provide through it.

16. Termination

You may stop using the Platform and request account deletion at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or unsafe conduct, or where required by law. Provisions that by their nature should survive termination (including Sections 11, 13, 14, 15, and 17) will survive.

17. Dispute Resolution & Governing Law

This section needs a deliberate legal decision, not a default. Common structures for a platform operating across Canada/Kenya/Tanzania include: (a) governing law and courts of the Buzlin Holdings Inc. entity’s home jurisdiction, generally [Ontario/Canada — confirm], with (b) an optional arbitration or mediation step before litigation. Mandatory arbitration clauses and class-action waivers are enforceable in some jurisdictions and restricted or unenforceable in others (including parts of Canada, for consumer contracts) — this needs jurisdiction-by-jurisdiction legal advice, not a copy-pasted clause.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you (such as by email or an in-app notice) before they take effect. Continuing to use the Platform after changes take effect means you accept the updated Terms.
